Powers of Attorney

There When You Need Someone To Represent You

All of us would wish to carry on running our personal and financial affairs for as long as we can, with the ability to make our own decisions.

However, there are many factors that could affect our capacity to do this, including severe learning disabilities, mental health problems, a brain injury or stroke, an accident causing severe injury, or simply old age.

Our experienced and specialist team understand the issues which arise from those suffering from a lack of capacity and have the skills to advise their clients when they find themselves facing these situations.

Lasting Powers of Attorney

Appointment of Deputies

A lasting power of attorney is a legal document that allows someone to choose other people who they want to make decisions on their behalf when they lack the mental capacity to make the decision themselves.

There are two types of LPA: (i) Property and Financial affairs and (ii) Health and Welfare. Penderlaw will help you decide what type of Power of Attorney would suit you and explain the nature and effects of creating this document.

When there is no Power of Attorney document it may be necessary to make an application to the Office of the Public Guardian or the Court of Protection to appoint a Deputy.

Our specialist team will guide you through this often stressful process and ensure that you understand every step of the way.
